Judge denies DOJ emergency bid to set aside California mail ballots

U.S. District Judge David O. Carter denied the Justice Department's request for an emergency order directing California election officials to set aside mail ballots linked to a list of roughly 20,000 registered voters whom federal officials allege are likely noncitizens. The written order is dated October 28, California time. The allegation does not establish those voters' citizenship or show that every person listed has cast a ballot.

Carter found that the government's identification methods raised reliability concerns and that a last-minute change to procedures, with voting already underway, risked excluding eligible voters and disrupting election administration. His order said the government had not demonstrated a basis for immediate relief. It also identified individual prosecutions for unlawful voting and California's existing procedures for canceling registrations of people proven ineligible as available remedies.

The ruling denies this temporary restraining order; it does not dismiss the underlying lawsuit or decide every listed person's eligibility. According to CBS News, the Justice Department plans to appeal and seek emergency relief from the Ninth Circuit. Federal prosecutor Bill Essayli said the administration believes processing the disputed ballots risks diluting citizens' votes. That is the government's position, not a finding of illegal votes in this decision.
