New York e-bikes and e-scooters: identify the vehicle and check local restrictions
New York DMV treats qualifying electric bicycles and electric scooters as different vehicle types. Appearance or a seller's label is insufficient: an e-bike must have operable pedals and meet the official size, power and classification requirements. These e-bikes are not registered as motorcycles, mopeds or ATVs.
State rules allow qualifying vehicles on certain roads posted at 30 mph or less, but local governments may further restrict where, when or how they operate. Sidewalk riding is not automatically allowed. Before buying or riding, check both DMV classification and the city's rules; a product's maximum speed is not necessarily a lawful operating speed.
